The human being’s mastery of itself, on which the self is founded, practically always involves the annihilation of the subject in whose service that mastery is maintained, because the substance which is mastered, suppressed, and disintegrated by self-preservation is nothing other than the living entity.

Gerontologists have proposed different concepts for ageing well such as ‘successful ageing’, ‘active ageing’, and ‘healthy ageing’. These conceptions are primarily focused on maintaining health and preventing disease. But they also raise the questions: what is a good life in old age and how can it be achieved? While medical in origin, these concepts and strategies for ageing well also contain ethical advice for individuals and societies on how to act regarding ageing and old age. This connection between gerontology and (...) ethics is overlooked by both schools of thought. We thus develop this research programme for a systematic geroethics in four steps. First, we analyze ‘successful ageing’ as put forward by Rowe and Kahn as a paradigmatic example of a gerontological conception of ageing well. Then, in a second step, we move from criticisms within gerontology to an ethical perspective; in particular, we want to clarify the problem of the claim of universal validity of conceptions of the good life. In a third constructive step, we explain how the ‘capabilities approach’ could be applied in this context as a normative foundation for the implicit normative assumptions of gerontological conceptions of ageing well, such as a particular choice of functionings, the ethical relevance of human agency, and the resulting claims of individuals towards society. Finally, using a concept developed by the German philosopher Ursula Wolf, we systematically develop the different aspects of the connection between ageing well and the theory of the good life in their full complexity and show their interconnectedness. Some of the recent criticisms published during and after the last revision process of the Declaration of Helsinki are directed at its basic legitimacy. In this article we want to have a closer look at the two criticisms we consider to be the most fundamental. The first criticism questions the legitimate authorship of the World Medical Association to publish a document such as the Declaration. The second fundamental criticism we want to examine argues that the last revision process failed to (...) meet the standards for fair, democratic procedures. Although both criticisms deny the formal legitimacy of the Declaration in the most fundamental way, they have never been addressed in detail in a single article. We refute most of the related arguments. However, acknowledging some of the points made, improvements for future revision processes and versions of the Declaration of Helsinki are outlined. (shrink)

Much has been written on Claude Bernard as a relentless promoter of the experimental method in physiology. Although the paper will touch Bernard’s experimental intuitions and his experimental practice as well, its focus is slightly different. It will address the laboratory, that is, the space in which experimentation in the life sciences takes place, and it will analyze the scattered remarks that Bernard made on the topic both in his books and in his posthumously published writings. The paper is divided (...) into four parts. The introduction briefly sketches the coming into being of the physiological laboratory in the first half of the nineteenth century. The second section will give an overview of Claude Bernard’s own itinerary in physiology and his personal laboratory experience. The third part of the paper will have a look at the image of the laboratory that Claude depicted in his Introduction to Experimental Medicine. In the subsequent section and by contrast, the image of the laboratory will come into focus as it can be reconstructed from Bernard’s notebook that he kept between 1850 and 1860, the Cahier rouge. Finally, the fifth part of the paper will spotlight Claude Bernard’s comparison of the sciences and the arts and their respective practices. A brief concluding statement tries to summarize Bernard’s epistemological position toward experimentally practiced science. (shrink)

The vast majority of empirical research on stakeholder management has traditionally focused on multinational corporations. Only in recent years, scholars have begun to pay attention to the stakeholder management concept in relation to small- and medium-sized enterprises (SMEs). The few existing studies in this area, however, discuss SMEs as a context free category or remain focused on single country analysis. This cross-national empirical research investigates SME owner-managers' perceptions of stakeholder management in six European countries. The comparative analysis is followed by (...) a discussion of how institutional, cultural and linguistic contexts can influence owner-managers' sensemaking of stakeholder management. Our study questions the universality of specific management terms and proposes that more attention should be paid to the institutional, cultural and linguistic environments that shape economic activity in different parts of Europe. In den philosophischen Diskussionen, die bereits im Vorfeld der Postmoderne unter dem Titel Jenseits des Subjekts stattfinden, geht es um eine radikale Infragestellung des Subjektbegriffs, eines der wesentlichen Konzepte der Philosophie der Neuzeit und der Moderne. Die Grundlage der Problematisierung des Subjekts ist eine kritische Diagnose, die der modernen Welt gestellt wird. Postmoderne Theorien vermitteln den Eindruck, in einer Welt zu leben, in der sich der Mensch aus dem Zentrum ins Ungewisse bewegt. Die «nachkopernikanische Welt» befindet sich in der Krise: (...) Individuen sehen sich unkontrollierbaren anonoymen Prozessen ausgeliefert und als Subjekte entmachtet. Zivilisations-, Kultur- und Technikkritik prägen das Weltbild, in dessen Zentrum die Kritik der Subjektivität steht. Die Kritik richtet sich gegen die als illusionär behauptete Selbstherrschaft des Subjekts. In den Beiträgen zu diesem Band geht es um die Frage, inwiefern eine derart radikale Infragestellung des Subjekts philosophisch gerechtfertigt werden kann. (shrink)

Sie warnt davor, angesichts des neurowissenschaftlichen Naturalismus zu resignieren, und plädiert für eine "kopernikanische Wende der Objektivität". Aufklärung über Repräsentation beruht auf der Klärung dessen, was Einstellungen, Meinungen und Überzeugungen sind und ob sie als wahr gerechtfertigt werden können. Daher steht die Rolle der freien richterlichen Überzeugung im Recht ebenso zur Debatte wie die Bedeutung von Überzeugungen in naturwissenschaftlichen Experimentalkulturen. Weil Ansprüche (...) auf die eine Wahrheit Kennzeichen totalitärer Herrschaft und Politik sind, schließt das Buch mit der Frage nach dem Zusammenhang von Wissen, Urteilsfähigkeit, Recht und Demokratie. Die Geschichte der Philosophie zu schreiben gilt weiterhin als ein in seiner hermeneutischen Programmatik selbstverständliches Unterfangen der Geistesgeschichte. In kaum einer anderen historisch verfahrenden Disziplin wird ein so geringer wissenschaftstheoretischer und methodologischer Aufwand für nötig erachtet, wie in der Geschichte der Philosophie. Rücken, wie es der Untertitel dieses Bandes ausweist, Probleme der Theorie, Methodologie und Methode der Historiographie der Philosophie ins Zentrum philosophischen Interesses, dann werden zwei Fragen unabweisbar: Wozu Philosophiegeschichte? Wie Geschichte der Philosophie schreiben? Sie verweisen zurück auf die (...) grundlegendere Frage: Wie ist das Verhältnis von systematischer Philosophie und Philosophiegeschichte zu bestimmen? Die Arten und Weisen, Geschichte der Philosophie zu schreiben, sind theoriegeladen; mit anderen Worten: Sie hängen ab von systemisch miteinander verbundenen ontologischen, epistemologischen und methodologischen Voraussetzungen. Was im Systematischen selbstverständlich geworden ist - eine Pluralität sich im Dialog kritisch anerkennender kontroverser Auffassungen, etwa des analytischen Realismus oder Antirealismus, der Transzendentalphilosophie und der Dialektik, der Hermeneutik und des Konstruktivismus, - bleibt in die Philosophiegeschichte noch einzuholen. Die zunächst philosophische, vor allem von Kant begründete Idee kosmopolitischen Rechts ist heute de facto in ein dynamisches, durchaus noch problematisches und deshalb weiter zu entwickelndes System des Internationalen Rechts transformiert: Menschenrechte nicht als Ideal oder gar Utopie, sondern als positives Recht, als jus cogens, erga omnes. Der Beitrag plädiert für eine pragmatische Re-Lektüre, in deren Ergebnis Kants Lehre als pragmatische Funktionstheorie von Recht und Staat verstanden wird und die zeigt, dass Kant an Bedeutung für unsere Zeit gewinnt, wenn man (...) auf spekulativ-metaphysische Begründungen verzichtet. Kants Rechtslehre ist kein untergeordneter Teil seiner Moralphilosophie. Es bedarf keiner moralphilosophischen Begründungen dafür, dass es Recht gibt. Warum es das Recht geben muss, ergibt sich ex negativo aus demselben Grund, aus dem die Rechtstheorie normative Theorie ist: Die Existenz des Rechts gründet darin, dass die Menschen vernünftig handeln sollen, de facto aber oft diesem Sollen nicht entsprechen. Weil dies nicht so ist, gibt es bei Kant das Recht mit seiner ›Befugnis, zu zwingen‹. Zwar hat Kants Rechtslehre eine moralphilosophische Dimension, in der zu begründen ist, wie – d. h. an welchen Werten orientiert – Recht und Staat sein sollen, aber das Recht hat in seiner Theorie im Interesse der Herstellung weltbürgerrechtlicher Verhältnisse Vorrang vor der Moral. Stanley Milgram was the first who tried to apply the results of his experiment on National Socialism. Historical science has hardly picked up on this subject with the exception of the American historian Christopher Browning. Despite of some serious problems which have occured by transferring the Milgram-experiment onto National Socialism we are convinced that the possibilities Milgram has opened up for contemporary history have not been exhausted yet. In this connection we would like to plead for a stronger distinction of (...) types of perpetrators, taking into account the latest results in criminology. The Milgram-experiment refers methodically to local studies of massacres and genocides. Its application on the bureaucracy of destruction seems particularly promising to us. Also, there should be included the rescuers of jews into the research on perpetrators as a controlling body. (shrink)
